New Hampshire Marijuana Lawyer

Facing Marijuana Charges? Find a NH Drug Crime Lawyer Near You!

Possession of any amount of marijuana remains illegal in New Hampshire even though small amounts are no longer considered a crime pursuant to N.H. Rev. Stat. Ann. §318-B:26, the statute that criminalizes the possession, possession with intent to sell, cultivation, manufacturing, sales, distribution, and trafficking of any controlled substance.

Possessing less than three-fourths of an ounce of marijuana in New Hampshire is a violation offense, resulting in a fine of up to $100 for the first or second offense. Possession of more than three-fourths of an ounce is considered a Class A Misdemeanor and a crime, resulting in up to a year in prison and a fine of up to $350.

However, certain marijuana offenses result in felony charges. The felony penalties for marijuana cultivation, sales, or possession with intent to sell are as follows:

  • 5 pounds or more: Up to 20 years in prison; maximum fine of $300,000; or both
  • 1 ounce or more: Up to seven years in prison; maximum fine of $100,000; or both
  • Less than 1 ounce: Up to three years in prison; maximum fine of $25,000; or both

How a Criminal Attorney Can Defend You

Still considered illegal, marijuana possession is one of the most common drug-related charges in New Hampshire. Our criminal defense lawyers regularly defend charges arising from the possession of marijuana. Drug cases often implicate constitutional concerns relating to search and seizure.

Our criminal defense team understands the issues implicated in drug cases, works with our clients to understand their priorities, and develops a strategy to resolve or try the case most effectively.

In many cases, we can create a plan for diversion, avoiding criminal convictions by putting together treatment and community service plans. In other cases, we identify factual and legal defenses and prepare the case for trial. In all these ways, a New Hampshire drug crime lawyer may be of critical assistance to you. Shaheen & Gordon, P.A. is one of the largest firms in the state, but our success is attributable to the individual attention we apply to our clients and their cases. Call today to discuss your marijuana charges and find out what an aggressive and successful member of our team can do to defend you from the penalties you are facing.

Fight Your Marijuana Charges in NH

With our help, you could fight your charges on several grounds. Searches of motor vehicles and homes often give rise to constitutional defenses.
