Scott M. Fogg
Biography
Scott brings substantial trial and litigation experience to Shaheen and Gordon. Scott spent nearly ten years as a Senior Deputy Prosecuting Attorney in Seattle , WA . While a prosecutor, Scott handled everything from misdemeanors to sex crimes to homicides. In addition to supervising and leading several trial divisions in the prosecutor’s office, Scott tried over a hundred cases to jury. In 2005, Scott was voted “Outstanding Trial Attorney” by his peers at the prosecuting attorney’s office of over 200 lawyers.
Following his tenure as a prosecutor, Scott spent several years working at a small civil litigation firm in Seattle . Scott developed a business litigation practice covering a broad area, including employment and labor law, administrative law, real estate law, and contract law. Additionally, Scott developed an active sports law practice including representation of professional athletes, NCAA student-athletes, and coaches. Scott also worked with several universities and colleges on a wide variety of issues.
Scott lives in Madbury, New Hampshire with his wife and three children.
Representative Cases
- Scott was selected by a national defense firm to consult with their litigation team on a variety of trial issues in a $50,000,000 medical malpractice case. Scott developed the jury selection outline and other key strategic elements used in trial.
- Represented an employee in the music industry who was alleged to be in direct violation of her non-compete agreement with her former employer. Case went to arbitration and employee was able to keep all of her challenged clients at her current firm after aggressive investigation and defense.
- Multiple challenges brought on behalf of both high school and collegiate student-athletes in support of their eligibility to participate in athletics.
- Represented clients in a six-figure real estate dispute. Case was dismissed after aggressive discovery and pre-trial motions.
- Represented a client whose company was sued in a personal injury claim stemming from a highway accident. Case was dismissed on summary judgment.
- Prosecuted and convicted an OB/GYN who had sexually abused his patients. Case received national attention and was featured on The Oprah Winfrey Show.
- Successful representation of clients in dozens of criminal cases, ranging from DUI to drug possession to assault to vehicular homicide.
