Arrested for Burglary?
Why You Need a Criminal Defense Lawyer in New Hampshire & Maine
The firm of Shaheen & Gordon, P.A. aggressively defends burglary cases,
taking the time to size up defenses and understand the circumstances surrounding
a burglary allegation.
Under
N.H. Rev. Stat. Ann. §635:1, burglary occurs when a person enters a building or occupied structure
with the plan to commit a further crime inside. Defending burglary charges
requires an analysis of available defenses, including false identification
and the motives of alleged victims to accuse someone wrongly. Our criminal
defense lawyers also evaluate the circumstances surrounding such an allegation,
including assessing concerns for drug and alcohol abuse, difficult domestic
circumstances and gambling addictions. Often, we find that by addressing
the underlying problem, we can create a compelling bargaining position
to resolve even difficult burglary cases.
Defining Burglary and Theft Penalties
Burglary is either a Class A or a Class B Felony, depending on the circumstances.
For instance, entering a home or other occupied structure at night, committing
any burglary while armed or causing a serious bodily injury in the commission
of a burglary results in a Class A Felony charge with exposure of up to
15 years at the New Hampshire State Prison. Other burglaries are considered
Class B Felonies, resulting in as much as 7 years at the New Hampshire
State Prison.
