Relocation

Child Relocation Attorneys in New Hampshire

When married parents make the decision to legally dissolve their relationship, a parenting plan can be set in place to establish child custody and visitation orders. There are many sacrifices that must be made in these situations and moving is often out of the question. The courts look at what is in the best interest of the child when determining what a parenting plan should entail.

At Shaheen & Gordon, we understand that life situations may require relocation and we can help you get the necessary legal permission to continue with this move, as well as assist with custody modifications. We also help parents who are not in favor of the relocation on the basis of it disrupting their child's life and restricting visitation.

How Do Courts Decide Parental Relocation Requests?

There are many considerations that a court takes into account when determining relocation. The most important factor, however, is the best interest of the child. Typically, the child's best interest is whatever allows him or her greatest access to both parents. A relocation request must be done in good faith and be in the best interests of the child, as opposed to relocating in bad faith, such for revenge or in retaliation to an ex.

Ultimately, the judge makes the decision on whether to permit or deny relocation.

Some acceptable reasons for relocation can include:

  • Starting a new job or higher paying job
  • Pursuing educational opportunities
  • Relocating to an area with lower cost of living
  • Being closer to family members who can assist with child care
  • Relocating after a new marriage

The judge also considers other statutory factors and we can also use these considerations to your advantage. If you have reason to believe that your ex-spouse's relocation would disrupt the child's life, we can help you prove your case.
