Definition of Burglary in New Hampshire

Under N.H. Rev. Stat. Ann. §635:1, burglary occurs when a person enters a building or occupied structure with the plan to commit a further crime inside.

Some examples of burglary can include:

Burglary Penalties

Burglary is either a Class A or a Class B Felony, depending on the circumstances.

  • For instance, entering a home or other occupied structure at night, committing any burglary while armed with a deadly weapon or causing bodily injury results in a Class A Felony charge with exposure of up to 15 years at the New Hampshire State Prison.
  • Other burglaries are considered Class B Felonies, resulting in as much as 7 years at the New Hampshire State Prison.
