“I feel the law firm of Shaheen & Gordon, P.A. and especially Attorney Jared O’Connor, Esq really genuinely care for their clients. Attorney O’Connor and his team always answers calls and emails extremely promptly and in the most professional and personal ways. Attorney O’Connor’s approach and care to for my family and I during this difficult time can’t be put into words. I have told Attorney O’Connor to please let his own family know what a difference he makes in his clients lives during such difficult times. I can’t recommend Attorney O’Connor and the law firm of Shaheen & Gordon enough! Thank you”
“Not only has this firm assisted myself but also my spouse through all the steps and questions involved with our workers comp case and made it so much less stressful. Any question or concern we had, Jared was patient and prompt to get us answers and help us understand. Whether it was over the phone or face to face, the staff and Jared were receptive and kind but firm and vigilant in the case. We could not have asked for better representation.
“Attorney Francis G. Murphy and Karen Matthews were truly outstanding. They were incredibly supportive and professional, and my husband and I felt we were in the best and most capable hands. My husband was in a car accident that resulted in injuries that ultimately resulted in him losing his job, a job that was very labor intensive. We received a settlement that we were pleased with and in a very timely manner. It is essential to mention that I strongly feel that we would not have received the settlement we deserved if we handled this on our own. I highly recommend that anyone considering representation in an injury case consider Francis and Karen.”
Types of workers’ compensation benefits in New Hampshire
Basic workers’ compensation benefits include:
- Lost wages (“indemnity benefits”)
- Payment of medical bills
- Vocational rehabilitation
- Permanent injuries or impairments
Lost wages
Weekly indemnity benefits are paid to you in place of the check you usually receive from your employer.
These are basically your “lost wages.” Under the law, if you are totally disabled from working, you are entitled to a weekly check from the insurance carrier in the amount of 60% of your gross average weekly wage. Generally, your average weekly wage is based on your last 26 weeks of paychecks before your injury.
Medical bills
Payment of medical bills is the other essential right of workers’ compensation. Any medical bills that you incur as a result of your injury are paid by the insurance carrier as long as the medical services are directly related to the workplace injury, and are reasonable and necessary.
This provision generally includes costs associated with prescriptions or over-the-counter medicines, or medical devices, and reimbursement for mileage to and from doctors’ offices.
Vocational rehabilitation
In some cases, vocational rehabilitation may also be appropriate. If after your doctor has released you to return to work, you are unable to return to your usual occupation because of your injury or illness, you may be entitled to receive help in finding a new job or occupation by way of a private vocational rehabilitation specialist, paid for by the insurance carrier.
Permanent impairment
If your doctor says that you have a permanent impairment, you are entitled to a certain sum of money depending on the extent of your injury. This lump sum award is evaluated by using the American Medical Association’s Guides to the Evaluation of Permanent Impairments.
If you are left with a permanent impairment after receiving all appropriate medical treatment, you should know exactly what you are entitled to. Don’t expect the insurance company to look out for your best interests.
Other benefits
You may be entitled to many other benefits, as well as obligations you have during the life of your workers’ compensation claim. Some of these laws involve statutes of limitations, return to work, reasonable accommodations, partial disability benefits, and many more.

Work-related injuries can happen in any industry, often leading to serious medical complications and financial stress. Some of the most common workplace injuries include:
- Falls – Slip and falls or falls from heights can cause severe injuries, often requiring long recovery periods.
- Neck and back injuries – Poor lifting techniques, prolonged sitting or standing, and falls can lead to debilitating spinal injuries.
- Vehicle accidents – Motor vehicle crashes involving delivery drivers, forklift operators, or company vehicles are common.
- Exposure to harmful substances – Loud environments, toxic chemicals, and inadequate safety gear can lead to respiratory, vision, or hearing damage.

Answers to common questions about workers’ comp in New Hampshire
How much time do I have to file a claim?
Under New Hampshire law (RSA 281-A:19), you must notify your employer of a work-related injury or illness within two years of discovery. However, delaying can weaken your case.
If your claim is denied, you have 18 months to request a hearing before the New Hampshire Department of Labor. Act quickly—call us today to protect your rights.
Can I sue someone other than my employer?
Workers’ compensation laws prevent lawsuits against employers, but you may be able to file a third-party claim if another party’s negligence caused your injury.
Examples of third-party liability include:
- Work-related car accidents caused by another driver.
- Defective equipment leading to injury.
- Negligent subcontractors or property owners who create unsafe conditions.
Do all employers carry workers’ compensation insurance?
In New Hampshire, all employers with any employees, whether full-time, part-time, or temporary, are required to carry workers’ compensation insurance. This includes non-profit organizations and family businesses with even a single employee. Sole proprietors and partners are exempt unless they choose to opt in for coverage.
What if I am partially to blame for my injury?
New Hampshire’s workers’ compensation system is no-fault, meaning you can receive benefits even if your own actions contributed to your injury. However, claims may be denied if the injury was due to willful misconduct, intoxication, or drug use. Otherwise, your right to benefits generally remains protected regardless of partial fault.
What if my workers’ comp has been denied?
If your New Hampshire workers’ compensation claim is denied, you can file an appeal with the Department of Labor. The process typically starts with a hearing before a Department of Labor hearings officer. You may also request a second-level hearing or appeal to the Compensation Appeals Board if necessary.
