New Hampshire Legislative Updates on PFAS

• In July 2024, HB 398 was signed into law, which adds a PFAS warning to the standard real estate conveyance warnings. This goes into effect on January 1, 2025.

• In August 2024, the Governor signed HB1649 into law. This includes a statute that requires polluters to provide property owners with safe drinking water either through payment for a municipal water connection or installation of a whole house treatment system (including payment of operation maintenance expenses), and to pay the property owner’s attorney fees and costs to obtain compliance. To this point, between the inequity in financial resources and the requirement to establish negligence, property owners have consumed contaminated water or relied on bottled water for years without relief.
