New Hampshire Relocation Attorneys

Child Relocation Attorneys in New Hampshire

When married parents make the decision to legally dissolve their relationship, a parenting plan can be set in place to establish child custody and visitation orders. There are many sacrifices that must be made in these situations and moving is often out of the question. The courts look at what is in the best interest of the child when determining what a parenting plan should entail.

At Shaheen & Gordon, we understand that life situations may require relocation and we can help you get the necessary legal permission to continue with this move, as well as assist with custody modifications. We also help parents who are not in favor of the relocation on the basis of it disrupting their child’s life and restricting visitation.

How Do Courts Decide Parental Relocation Requests?

There are many considerations that a court takes into account when determining relocation. The most important factor, however, is the best interest of the child. Typically, the child’s best interest is whatever allows him or her greatest access to both parents. A relocation request must be done in good faith and be in the best interests of the child, as opposed to relocating in bad faith, such for revenge or in retaliation to an ex.

Ultimately, the judge makes the decision on whether to permit or deny relocation.

Some acceptable reasons for relocation can include:

  • Starting a new job or higher paying job
  • Pursuing educational opportunities
  • Relocating to an area with lower cost of living
  • Being closer to family members who can assist with child care
  • Relocating after a new marriage

The judge also considers other statutory factors and we can also use these considerations to your advantage. If you have reason to believe that your ex-spouse’s relocation would disrupt the child’s life, we can help you prove your case.

Working with Andrew has been a completely different experience from my past representation. His expertise in the law was clear in the way he handled the bifurcate judgment from the opposing party, especially after my previous lawyer told me I had 90 days to pay the other side. Andrew knows the jurisdiction, and it made a real difference in the outcome.

He is efficient in and out of court. In court, he was organized, calm, in control, and used his time well. Outside of court, he keeps conversations focused and productive.

He keeps his word throughout the process. Everything he has said he would do, he has done on time or early.

Andrew is also accessible and responsive. I never have to go through an admin or schedule time just to get an answer. I’m grateful for his representation.

Tracey [Goyette Cote], I can’t thank you and Laura enough for helping [Client] get through this unpleasantness. As a lawyer myself, I was very impressed by your responsiveness, professionalism, competence and empathy. I am not sure I will ever need legal representation in your neck of the woods, but if so, I would call you first. And, I will gladly recommend you if ever asked for a recommendation of NH counsel.
