Penalties for Fraudulent Statements in NH & ME

Tax fraud is a serious federal offense that can be committed by any individual, corporation, employee, or employer.     • Maximum fine of $1,000; up to one year in prison; or both
  • Fraudulent Withholding Exemption Certificate / Failure to Supply Info (26 U.S.C. §7205):
    • Maximum fine of $1,000; up to one year in prison; or both
  • Fraud and False Statements (26 U.S.C. §7206):
    • Maximum fine of $100,000; three years in prison; or both
  • Fraudulent Returns, Statements, or Other Documents (26 U.S.C. §7207):
    • Maximum fine of $10,000; one year in prison; or both

How is tax fraud committed?

A person or corporation commits tax fraud by knowingly providing, delivering, or disclosing fraudulent information for the purpose of paying less taxes than they truly owe. Similarly, crime of tax evasion occurs when a party willfully attempts to avoid or defeat any taxes they owe to the local or federal government. The IRS aggressively pursues anyone who has fallen behind on their taxes or who has provided false information; however, many cases involve individuals or corporations who made an honest mistake on a return, resulting in an investigation and charges of fraud.
