New Hampshire and Maine continue to treat simple possession of even small amounts of marijuana as a criminal offense even as our neighboring states decriminalize this offense. As a result, anyone convicted of committing a marijuana crime is penalized under N.H. Rev. Stat. Ann. §318-B:26, the statute that criminalizes the possession, possession with intent to sell, cultivation, manufacture, sales, distribution, and trafficking of any type of controlled substance. The possession of a small amount of marijuana possession in New Hampshire is considered a Class A misdemeanor. However, certain marijuana offenses result in felony charges, relating to quantity, manufacture or intention to sell marijuana. The penalties for marijuana possession, PWI, sales, and distribution are as follows:

  • 5 pounds or more: Up to 20 years in prison; maximum fine of $300,000; or both
  • 1 ounce or more: Up to 7 years in prison; maximum fine of $100,000; or both
  • Less than 1 ounce: Up to 3 years in prison; maximum fine of $25,000; or both
